2) Eligibility & Accounts

• You must be at least 13 to use the Site, and at least 18 (or the age of majority in your area) to place orders.
• You’re responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
• Please let us know right away if you suspect unauthorized use of your account.

3) Changes to These Terms

We may update these Terms occasionally to reflect changes in our business, products, or the law. When we do, we’ll update the “Last updated” date below. If you continue to use the Site after changes take effect, you’re agreeing to the updated Terms.

4) Orders, Pricing & Payment

• Placing an order is an offer to buy. We may accept or cancel an order at our discretion (for example, if there’s a stock or pricing error).
• Prices, promotions, and availability can change without notice. Taxes and shipping are calculated at checkout.
• We use trusted third-party payment processors. We don’t store full card numbers on our servers.
• If we cancel an order after payment, we’ll issue a refund to your original payment method.

5) Shipping, Risk of Loss & Returns

• Title and risk of loss pass to you when we hand the order over to the carrier.
• Delivery timing can vary based on carrier performance and location.

6) Product Info & Safe Use

• We work hard to keep product descriptions, photos, and scent/flavor notes accurate. Minor variations in color, finish, or packaging can occur.
• Brew guides, recipes, and tips are informational only. Always use care with hot liquids, electrical equipment, and sharp tools.
• For candles and wax melts, always follow safety guidelines on the label and on our Candle & Wax Melt Safety page.

7) Promotions, Gifts & Givebacks

• Promo codes apply only to eligible items and dates as described in the offer. They usually can’t be combined unless stated.
• Gift cards or store credits (if offered) are subject to the terms provided at purchase and may have region or usage limits.
• Coo Coo’s Cares: When we display a percent-of-sales pledge on certain products, we’ll summarize the campaign period and totals on our Coo Coo’s Cares page. These purchases are not tax-deductible donations.

8) Reviews & User Content

If you post a review, photo, comment, or other content (“User Content”) on the Site or tag us on social, you grant Coo Coo’s Coffee a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and share that content in connection with our store and marketing.

You promise that you own or control the rights to your User Content and that it doesn’t infringe anyone else’s rights. For more detail, see our UGC Terms.

9) Acceptable Use

• Please don’t misuse the Site, interfere with security, or attempt to access data you’re not authorized to see.
• Don’t use automated tools to scrape or overload the Site beyond normal shopping and browsing.
• Don’t submit false orders, fraudulent chargebacks, or use stolen payment methods.

10) Intellectual Property

The Coo Coo’s Coffee name, logos, product names, artwork (including Bert the gecko), designs, text, and other content on the Site are owned by or licensed to us and protected by intellectual property laws. You may not use our IP without written permission, except as necessary for normal personal use of the Site.

11) Third-Party Services

We use and link to third-party services (like payment processors, shipping carriers, analytics, and review platforms). Those services are governed by their own terms and privacy policies. We’re not responsible for their content or practices.

12) Disclaimer of Warranties

To the maximum extent allowed by law, the Site and all products are provided “as is” and “as available,” without warranties of any kind, express or implied. That includes implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

13) Limitation of Liability

To the maximum extent allowed by law, Coo Coo’s Coffee and our owners, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or products.

Where liability cannot be excluded, our total liability to you for any claim will not exceed the amount you paid us for the product(s) at issue.

14) Indemnification

You agree to indemnify and hold harmless Coo Coo’s Coffee and our team from any claims, damages, or expenses (including reasonable attorneys’ fees) arising from your violation of these Terms or misuse of the Site.

15) Governing Law & Disputes

These Terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-law rules. You agree to the exclusive jurisdiction of the state and federal courts located in Florida for disputes that aren’t subject to small-claims court or another process required by law.
